By proceeding with a purchase, you are entering a legally binding agreement with Foliar Flush. It is your responsibility to read and understand the Policies, Terms and Conditions prior to purchase.

The terms presented on this website are subject to change without notification. It is therefore the customers responsibility to revisit these terms, conditions and policies before each purchase. The last date of update is specified on this page, however, Foliar Flush does not guarantee accuracy of this date, so reading the terms again is advised.

Foliar Flush operates under the registered company of Rutaceae (Swedish Organisationsnummer: 860512-1071). Therefore The primary Swedish governing body for consumer complaints and dispute resolution between consumers and businesses is the National Board for Consumer Disputes (ARN). For general advice and information on consumer rights, you can contact the Swedish Consumer Agency (Konsumentverket).
2. Definitions
Biological Entity: Any live product, included but not limited to microorganisms, seeds/corms/tubers/bulbs/rhizomes and plants.
Collectable: Products that are highly sort after by collectors and enthusiasts. Common in cultivation.
Content: literary, imagery and other content, such as audio, intended for persons with and without disability.
Customer/You: A person financially bound to a purchase.
Damaged Product: A product that has diminished integrity due to
Environment-related Variations: Separate from general variations, this refers to biological imperfections, such as impact from environmental conditions that are visible on the product but do not pose a health risk to the product.
Foliar Flush/Company/We/Us/Our: The legal entity under the registered company of Rutaceae (Swedish Organisationsnummer: 860512-1071) and appointed persons responsible for business activities.
Phenotypical Variations: Changes to properties of the products, including but not limited to, dimensions, age, growth form, and colour.
POUR: Perceivable, Operable, Accessible, and Robust.
Product/stock/items: Biological entities offered for sale on the Foliar Flush website.
Product Descriptors: Any feature (tangible and/or intangible, such as smell) of a biological entity.

3. Product Descriptions & Variations, Continued Care, and Disclaimer
3.1. Product Descriptions
Foliar Flush adds product descriptions to its product listings. These general descriptors may include details relating to dimensions, shape, colour, age and other descriptors. Where dates are added to represent the age of a plant, the format of the date conforms to the Swedish convention (YYYY-MM-DD). The general descriptors are a representation of the standard stock produced, grown, or procured by Foliar Flush. Some descriptions will note that associated images are similar to the products available, this does not nullify the possibility of product variations.

The images on the Foliar Flush website are for illustration purposes only. Some descriptions will note that associated images are similar to the products available, this does not nullify the possibility of product variations.
Most of the images on the website were generated by Foliar Flush of products for sale. The images are accompanied by descriptions for the purpose detailed in "Product Descriptions". Where images depict mature plants, such as those in flower, these are for illustrative purposes only and do not represent expectations of the products you will receive unless specifically stated.
3.3. Product Variations
3.3.1. Phenotypical Variations from Descriptors:
Product descriptions are a generalization of stock at time of writing. Products offered on the Foliar Flush website may exhibit phenotypical (common attributes) variations from descriptors, including, but not limited to, dimensions, shape, colour, age and/or other descriptors . Phenotypical variations do not impact the health of the products. Some descriptions will note that associated images of the products are similar to the products available, this does not nullify the possibility of product variations.
3.3.2. Environment-related Variations from Descriptors:
Environment-related variations are a consequence of biology that includes, but is not limited to: biological responses to environment changes; or changes in growth cycle due to dormancy in winter. In such cases, deviations from general descriptors are not those that impact the health of the products. Some descriptions will note that associated images are similar to the products available, this does not nullify the possibility of product variations.

3.3.3. Biological Entity Viability
Biological entity viability is variable and beyond the control of Foliar Flush. Under no circumstances is Foliar Flush responsible for viability rates of seeds/corms/tubers/bulbs/rhizomes or other biological entities.

3.4.Propagation Efficacy, and Continued Care​​
3.4.1. Propagation Efficacy
Foliar Flush has no control over the execution of propagation methods by the end user or the environment or environmental controls required. Therefore, under no circumstances is Foliar Flush responsible for the propagation efficacy of end user after delivery of product.

3.4.2. Continued Care of Plants in Vegetative Phase
Foliar Flush has no control over the execution of growing methods by the end user or the environment or environmental controls required for successful growth of plants delivered in vegetative phase. Therefore, under no circumstances is Foliar Flush responsible for the continued care and successful growing of plants in vegetative phase upon delivery.

Foliar Flush provides descriptions and advice for informational purposes only and is not liable for any damage caused by incorrect use or reliance on general advice. ​​​​
4. Return, Refund, and Cancellation Policy
4.1. Return Policy
4.1.1. Unwanted Purchases:
Currently, Foliar Flush only operates within the EU. Within the EU, the Right of Withdrawal does not apply for online (or in store) purchases of plants, which are classified as perishable goods, as per the Distance Contracts and Off-Premises Contracts Act.​​​

4.2. Refund Policy
​4.2.1. Refund of Damaged Products:
In the event of a parcel(s) and product(s) arriving damaged (see Return Policy & Shipping Policy) a return form/refund request email should be submitted to Foliar Flush with photographic evidence within 48 hours of delivery (see Shipping & Delivery T&Cs). Valid claims will be refunded. Foliar Flush will refund the cost of postage and product(s) affected by the damaged parcel. No additional compensation will be considered.

4.2.2. Refund Time frame:
When a refund request is accepted, Foliar Flush aims to process refunds within seven calendar days from receipt of the returned items (including day of receipt of the return parcel). The time frame for processing will vary depending on the customers location and bank. Therefore, a specific time frame cannot be provided.

If you have not received your refund within 14 calendar days of confirmation of refund, please contact your bank first, as they may have information of pending transactions. You are also welcome to email Foliar Flush customer service for confirmation of refund processing.

4.2.3. Refund Method:
Refunds are processed via the method of payment. It is not possible to change to a different payment method for a refund.

4.3. Order Cancellations
4.3.1. Cancellation of a Whole Order
If you want to cancel your order, a cancellation request must be sent to Foliar Flush. The quicker the request is submitted the higher the chance of successful cancellation. If the processing of your order does not allow for cancellation, your cancellation request will be declined and the order will proceed as planned. If the cancellation request is approved, the order will be cancelled and a refund issued. The refund will include the full price paid, including shipping costs.

4.3.2. Cancellation of Part of an Orders
It is not possible to cancel part of an order. If the processing of an order allows for cancellation, the full cancellation process will be actioned (see Cancellation of Whole Orders) and a new order can be placed.
5. Shipping and Delivery T&Cs
5.1. Shipping
5.1.1. Shipping Details:
It is the customers responsibility to ensure accurate shipping details are added when processing an order. Foliar Flush is not responsible for delivery issues caused by incorrect shipping details being provided by the customer. Foliar Flush is not responsible for damaged products as the result of delays caused by incorrect shipping details provided by the customer.
5.1.2. Postponed Dispatch During Incompatible Weather Conditions:
Due biological entities being susceptible to damage due to environmental conditions, dispatch of deliveries may be postponed. This is to ensure that products arrive undamaged and uncompromised.
5.2. Delivery
5.2.1. Packaging:
Foliar Flush takes great care in preparing packages for transit to ensure your products arrive undamaged. Aside from damage, it is not unreasonable to experience a degree of substrate spillage.

5.2.2. Damaged Parcels and Products:
In the event of products arriving damaged due to damaged parcels, Foliar Flush kindly requests that you include an image of the damaged parcel, before opening it (where possible), in your return request form/email (see Return and Refund Policies). This is to help us quickly address and resolve the issue with the courier service provider.

5.2.3. Delayed Deliveries
In the event of a delayed delivery, customers can either contact the courier company directly or place and enquiry with Foliar Flush. As Foliar Flush uses a third party service for shipping, we are not responsible for delayed delivery times. If the product arrives in good health, Foliar Flush will not provide compensation or a refund. If the product arrives damaged, the Refund Policy applies.

NOTE: Foliar Flush does not currently provide return labels. Therefore, the cost of retuning items is the responsibility of the customer. However, in the case of damaged parcels and products, there may not be a need to return the item(s) for a replacement or refund. This will be taken on a case-by-case basis (see Refund Policy).
6. Pricing and Payment T&Cs
6.1. Pricing
By Default, the prices on the website are listed in Euros (EUR) unless users change the currency setting manually or automatically via their electronic devices. The prices on the website may change without notification. This could be due to many factors, including, but not limited to, changes in the market, changes in size and/or age of the plants, or pricing errors. In relation to pricing errors, Foliar Flush reserves the right to cancel and refund an order, where applicable.

6.1.1. Justified Pricing
​In rare circumstances, plants with aesthetic uniqueness that do not command a premium will be offered for a comparatively lower price than products with similar product descriptors (for example, the same species with the same/similar age and size). In such cases, all policies and T&Cs apply as the pricing is calculated in respect to the cosmetic appearance for plants that are otherwise equally as healthy as higher priced products with similar descriptors. Foliar Flush does not provided pricing adjustments upon request.

6.1.2. Sales Pricing
Foliar Flush does not participate in sales.

6.2. Payments Terms
The website and payment management system accepts a selection of payment options. There is no option to pay outside of the website and payment system options. In unique and rare cases, a payment link might be possible to send to a customer. However, it will be processed via the same payment system so the same payment options will apply. Orders are not dispatched until full payment has been received.

Refund payment will be made to the same account from which the original purchase was made. See Refund Policy for refund information.

7. Ordering and Availability T&Cs
7.1. Ordering and Availability
7.1.1. Ordering:
Orders are placed via the Foliar Flush website. Unforeseen stock reductions, damaged product replacement, or technical issues that may at times impact the stock availability linked to the website. Order that cannot be fulfilled will be cancelled. Due to a number of products being rare very rare, or extremely rare in cultivation, it may not be possible to determine and state stock replenishment time frames. Some products may only be available once. Foliar Flush will communicate with the customer to inform of stock fulfillment issues but is not required to offer similar or dissimilar items for a matched/reduced price, nor with compensation be offered in any case.

7.1.2. Availability:
Foliar Flush offers a selection of collectable, rare, very rare, and extremely rare plants (see Definitions). As a result, stock may be listed for a very short period. Foliar Flush reserves the right to refuse requests to reserve/hold products. Foliar Flush does not offer the possibility for partial payment to reserve/hold stock.
8. Limitation of Liability
8.1 Limitation of Liability
Foliar Flush aims to provide products are true to descriptions with reasonable variability (phenotypical and environmental). The plants supplied should also be in good health upon dispatch to the customer. If plants do not meet the Foliar Flush standard, customers may apply for a refund. The customers reimbursement shall be limited to the total purchase value to which the deviation pertains.

Foliar Flush will not, in any case, be liable for any loses or damages incurred to the customer. This includes consequential, direct, indirect, loss of business profits, or any other loss or damage.

It is not permitted in any case to use Foliar Flush imagery for commercial use without written permission from Foliar Flush.
